? TERM. These Economic Conditions will remain unchanged until 31.12.2027. At the end of that period, Enerviva may amend the Economic Conditions by giving the Customer written notice at least three months before the date on which the change takes effect. If no such notice is given, these Economic Conditions will be deemed extended from month to month until further notice. The Customer may withdraw without charges by choosing a new supplier; if the Customer does not withdraw, the notified changes will be deemed accepted. Unless proven otherwise, the notice is presumed received ten days after Enerviva sends it. ? EARLY TERMINATION. If the Customer withdraws from the contract before 31.12.2027, the Customer must pay a fee to cover the economic loss suffered by Enerviva because of the early termination, in accordance with ARERA Resolution 250/2023/R/com. The fee will be calculated as the difference between the market prices (mark-to-market) for the remaining months calculated at the time of withdrawal and those calculated on the contract signing date, multiplied by the contractual volume not supplied to the Customer following withdrawal. The fee will not exceed €243; this maximum is based on 2,700 kWh not delivered, valued at a market price difference of €0.09/kWh.
