Supply will take place in accordance with the minimum time limits set by ARERA and subject to the withdrawals from previous suppliers having taken effect. Supply is conditional on the relevant parties activating the Transport, Dispatching, Transmission and Ancillary Services referred to in Article 4 of the CGC. If the PDR and/or POD is not connected to the local distribution network, the time limits will run from completion of the connection and the issue of the necessary authorisations/approvals. The expected start date of supply performance is stated in the Supply Request and will generally be from the second month after the date it is signed. Where permitted by regulation, as a contribution towards administrative costs for handling service requests, Onda Più will also include on the bill a fixed one-off charge of €30.00 (thirty/00 euros), unless otherwise stated in the Economic Conditions.

Consumption is billed on the basis of meter readings taken and made available by the Distributor or, if these are unavailable, on the basis of a self-reading (where available) submitted by the Customer and validated by the Distributor. If no consumption data is provided, Onda Più will issue bills as provisional payments, subject to subsequent adjustment, based on the Customer’s historical consumption or on data provided by the Customer in the Application or during the supply period.

If any amount owed to Onda Più is not paid or is paid late, even in part, five (5) days after the payment deadline stated on the bill, Onda Più will send the Customer written notice by registered mail or certified email, pursuant to ARERA Resolutions 258/15/R/com and ARG/gas/99/11. The notice will state: the deadline by which the Customer must pay the amount owed to Onda Più, which will be no less than twenty (20) days from the issue of the formal notice of default, except where the deadlines may be shortened under Articles 3.4 of Resolution 258/15/R/com and 4.2bis of Resolution ARG/gas/99/11; how the Customer may notify Onda Più that payment has been made; and that, if payment is not made within twenty-five (25) calendar days after the Customer receives the formal notice of default, or within forty (40) calendar days for a Customer not supplied at low voltage (BT), Onda Più may, without prejudice to its right to terminate the Contract under Article 1456 of the Italian Civil Code, call on the guarantee and/or, if the unpaid amount exceeds the amount of the guarantee: for electricity supply only, reduce the supply to 15% (fifteen percent) of the available capacity, where the meter’s technical specifications allow this, and, fifteen (15) days after reducing the capacity, ask the Local Distributor to suspend supply; or, for natural gas supply only, ask for the PDR to be closed and supply suspended due to non-payment. For this purpose, the Customer undertakes to allow access to the premises where the metering equipment is located so that supply can be disconnected. If supply to the PDR cannot be interrupted, administrative termination due to non-payment will be carried out, and the following will be sent to the Local Distributor: unpaid bills; documents relating to the formal notice of default; a copy of the contract termination notice with confirmation that the Customer received it; a copy of the supply contract or the latest paid bill; and a summary document showing the outstanding credit. Any reconnection of supply following suspension or closure due to non-payment will take place according to the procedures set out in Article 90 of ARERA Resolution 646/15/R/eel. Onda Più may charge an amount up to the limit set by ARERA, in addition to the costs of managing the formal notice of default procedure, set at a maximum of €25.00 for each reminder sent. If the rules on formal notices of default and suspension are not followed, the Customer will be entitled to the automatic compensation provided for.
