As security for the obligations arising from the Contract, unless otherwise provided by ARERA, Forini reserves the right to request payment at any time of a security deposit equal to the average consumption for 3 (three) months of Supply, determined on the basis of the annual consumption communicated by the Distributor and multiplied by the Supply price, including taxes, in force at the time of calculation for the offer applied to the Customer. The security deposit will be charged on the first available invoice, with a minimum of €50.00 (fifty/00 euros). Forini may request payment of the security if the bank direct debit for the Electricity and/or Gas Supply is revoked or interrupted even just 1 (one) time within a period of 1 (one) month. Forini reserves the right to request any supplements to the security deposit if, during the Supply, significant changes occur in the calculation parameter and/or in the Customer’s financial situation that increase the Customer’s risk of non-payment (e.g. payment delays of more than 30 (thirty) calendar days after the due date, for 2 (two) invoices, including non-consecutive invoices). A creditworthiness check and any request for financial guarantees (bank guarantee or security deposit) may also be carried out during the Supply, and the related costs incurred by Forini will be charged again to the Customer. The Customer’s activation of bank direct debit does not constitute grounds for automatic repayment of the security deposit by Forini.
